Can a proxy holder be found liable for his vote in an HOA? Or would it be the homeowner who gave the proxy?

Say a homeowners' association member gives his proxy to another member,who then casts a vote for something which is contrary to the CC%26amp; R's or Corp Code rules. Can either be held liable, and if so, is it the proxy giver or the proxyholder? Or both?

Depends on the wording of the proxy. As a rule. the person casting the vote.
